Sharpening Your Testifying Skills

This session explores ways to sharpening your testifying skills including 1) armed for bear; getting ready for depositions; 2) effectively delivering your message to the jury; 3) cross examination; don't lose your head; 4) learn tips to excel at cross-examination; 5) obtain practical ways to deal with answering those difficult questions; 6) how to avoid a Daubert challenge; and 7) in-depth understanding of why experts were excluded under Daubert.


Insurance and Claims: What You Need to Know

This session will address best practices, due care, risk control and proper errors and omissions coverage for professionals providing litigation support services.  We will discuss the claim reporting and handling process from beginning to end.  Specific examples of claims which could likely have been avoided if approached differently will be presented and “lessons learned” will be offered.  Finally, we will highlight areas where claim frequency is high and offer suggestions to avoid them.

Breakout 2: Condominium Fraud - On the Rise!

Time: Thursday 1:45pm - 2:35pm Credits: 1 AA

This session will explore the increasing growth of condominium and homeowner association fraud.  We will discuss the uniqueness of this industry, its propensity for fraud, and how the "Fraud Triangle" applies to actual fraud cases.


Case Law Update

Examine four or five recent valuation or litigation related cases. Learn how the courts and valuation/litigation experts are dealing with current issues.


Breakout 3: Dual Class of Stock: Dueling Theories of Valuation

Time: Thursday 3:45pm - 4:35pm Credits: 1 TB

Learn about the various types of equity securities and the typical circumstances for their issuance. After describing the nuances of these securities, this session will explore common and esoteric approaches and methodologies for valuing such securities in a complex capital structure. These approaches and methodologies will also describe the payoff structures of securities within a complex capital structure. Finally, an overview of the considerations for including debt, or debt-like instruments, in the valuation of complex capital structures will be presented.


Breakout 4: Destroying the Plaintiff's Damage Calculation: Death by a Thousand Cuts

Time: Thursday 3:45pm - 4:35pm Credits: 1 TB

Through the use of an actual case study, learn how to identify critical assumptions to the opposing expert's damage calculations; identify its flaws and contradictions; provide credible corrections to errors and unreasonable assumptions made by the expert; and, step-by-step, provide effective rebuttal testimony that is easily understood by the judge or jury.


Panel Discussion: At the Bench with the Judges

Time: Thursday 4:40pm - 5:30pm Credits: 1 TB

Judges will discuss the importance of expert testimony in the outcome of trials and share examples of trials where expert testimony was demonstrably critical to the outcome. Judges will share their thoughts about how they apply the expert testimony admissibility statute (Fla. Statute 90.702) and whether they have granted more motions to exclude after Florida adopted the Daubert standard and abandoned the former Frye standard.
