Going Concern: What Nonprofit Organizations' Management Teams Need to Know

The FASB recently issued Accounting Codification Update (ASC No. 2014-15, Presentation of Financial Statements-Going Concern (Subtopic 205-40), Disclosure of Uncertainties about an Entity's Ability to Continue as a Going Concern.
Nonprofit organizations should take note that the going concern principle is presumed as the basis for preparing financial statements-unless and until the nonprofit's liquidation becomes imminent. If and when a nonprofit's liquidation does become imminent, financial statements should be prepared under the liquidation basis of accounting in accordance with Subtopic 205-30. This session will cover key provisions of FASB ASC 2014-15; practical considerations on evaluating the nonprofit organization's going concern; documentation requirement of those evaluations; and the required disclosures in the financial statements.

Fresh Opportunities in New Markets Tax Credits Financing for Not-for-Profit Organizations

Congress has acted to extend the federal New Markets Tax Credits program for five more years at current funding levels. Florida remains one of ten highly sought after states for financing operating businesses, not for profit organizations, and real estate projects due to its status as a targeted state by the Community Development Financials Institutions Fund. As a stand alone or paired with other tax credit and governmental incentive programs, including EB-5, historic rehabilitation tax credits, grants, or bond financing, NMTC financing can provide a critical missing piece and assist an otherwise marginal project become economically successful.
Federal and State of Florida New Markets Tax Credits financings offer a valuable “tool” to add as an option or gap filler in a capital stack on either hard capital or operating capital expansions or shortfalls. Many businesses, including not for profit entities, experience a critical need to grow operating capital or bolster a capital campaign for a programmatic or physical expansion. In general, federal NMTC financings can provide a an operating business or real estate project with an twenty to twenty-five percent (20-25%) net benefit in relation to project costs. State NMTC financings similarly can provide a project with a net benefit between ten and fourteen (12- 14%) of eligible project costs. In many cases the State of Florida and federal credits can be stacked or twinned to increase the net benefit for the project.
