Overview:


This course adds a unique and often unspoken of weapon to the CPA’s ability to protect clients. Florida agencies (e.g., Department of Revenue) must promulgate rules to take certain positions, most of the time. What happens if a statute or rule does not identify a policy used by the agency to the detriment of a client? This presentation will answer that precise question and how a CPA can potentially invalidate state action based on the principal.

  • Identify when an agency uses a nonruled policy 
  • Learn what options are available to clients when a nonruled policy is used
  • Consider possible upside and downside ramifications to challenging agency
