As a follow-up to the Governmental Affairs Department’s January 14, 2008 Listserv post informing the CIRA section that House Speaker Marco Rubio created a Select Committee on Condominium & Homeowners Association Governance (See complete message below), Rep. Julio Robaina (Chair) has scheduled a meeting of the select committee for the following Saturdays in Miami Beach, Orlando, Tampa and Tallahassee. Refer to the meeting notice below for details.

The purpose of the meetings is to examine state governance of condominiums, cooperatives, and homeowners associations, to include accounting, budgeting, audits, theft by officers and directors, elections, and access to records, the state regulation of condominiums and cooperatives by the Department of Business and Professional Regulation.

The Chair has invited representatives of the Department of Business and Professional Regulation, the Condominium Ombudsman, and other interested parties to attend the meeting. The Select Committee will hear testimony from the public regarding issues with their association, and will attempt to resolve issues where possible.

Chairman Robaina asks that members of the public who testify before the Select Committee be prepared to offer specific recommendations for amendments to the laws governing associations. Such laws are primarily found in Chapters 718, 719, and 720 of the Florida Statutes. House Speaker Marco Rubio announced last Friday (see below) the creation of the Select Committee on Condominium & Homeowners Association Governance. The select committee shall be limited to meetings in Miami Beach, Sunrise, Orlando and Tampa, with a final meeting on March 3, 2008 in Tallahassee.

The Governmental Affairs Department will post to the CIRA listserv the dates/times/locations once they become available. 

Dear Clerk Pittman:
In accordance with Rule 7.6, I hereby create a Select Committee On Condominium & Homeowners Association Governance. The Select Committee is authorized to exercise all powers available under the Rules of the House. The Committee is authorized to take any actions and make any recommendations consistent with its powers prior to the start of the 2008 Regular Session.

The purview of the select committee shall be limited to the governance of condominiums, cooperatives, and homeowners associations, to include accounting, budgeting, audits, theft by officers and directors, elections, and access to records, the state regulation of condominiums and cooperatives by the Department of Business and Professional Regulation. The select committee shall b limited to meetings in Miami Beach, Sunrise, Orlando and Tampa, with a final meeting on March 3, 2008 in Tallahassee. The select committee and its members are hereby authorized to incur travel expenses for this purpose. Travel requests must be submitted in advance.

A final report of the committee findings and recommendations shall be submitted no later that March 3, 2008. The report shall be addressed to the Speaker, the Jobs & Entrepreneurship Council, and the Safety & Security Council
